A financial power of attorney can be an important part - and in some cases, the most important part - of your estate planning. If you are no longer able to manage your financial affairs yourself, you may want someone you trust to help you. A financial power of attorney is a legal document giving that trusted person, called an agent, the power to act on your behalf.

With a financial power of attorney, you can give your agent the power to do tasks for you such as banking, paying bills and applying for benefits. You can also give the agent greater responsibility and allow him or her to sell your home, transfer your assets, manage your investments or delegate authority to someone else. You decide how much power the agent will have and can add additional language limiting or extending the agent’s powers.

The Oregon Financial Power of Attorney also allows you to choose whether you would like your agent to start acting for you right away and despite any future incapacitation (which would make it durable), or only if you are ever declared unable to manage your affairs. You are also able to change or revoke your power of attorney at any time as long as you are doing so voluntarily and are deemed of sound mind.
