New Hampshire Durable Power of Attorney (Financial)

Last Updated: 5/20/2015

Document Description

A Financial Power of Attorney is a document that allows you, the principal, to give power to a trusted agent or attorney-in-fact to make decisions you would normally make yourself. In this case, the decisions made are all based on your fiscal life. Be aware that with this document, you are giving power and authority over your money matters to someone else. It is important to make sure the person you assign is both trustworthy and competent.

While not mandatory, a financial power of attorney will certainly help if and when you become incapacitated and/or mentally incompetent. This form can become effective immediately, if you so choose. Be sure to note that if the form does take effect immediately, it will stay valid if you become incompetent.

The ezEstatePlanner document builder makes it easy to create a well-drafted version of the New Hampshire Financial Power of Attorney. Using the document builder, you can authorize the attorney-in-fact to make bill payments, file tax returns, make monetary gifts to family members on your behalf and even conduct real estate transactions for you. Since this form is customizable, you are also able to add special directions or stipulations for your attorney-in-fact.

In the state of New Hampshire, the financial power of attorney must be signed by a notary public, judge or court clerk. Although it must be signed by an official from the court, it does not need to be filed before the court or any other agency.
