North Dakota Living Will (HealthCare Directive)

Last Updated: 11/23/2015

Document Description

What is a living will, and why do you need one? In North Dakota, you have the right to make your own choices about your personal medical care and treatments. If you should even become unable to speak for yourself, you can protect this right by having a living will.

A living will lets you exercise your right to accept or refuse various medical treatments. It is designed to be used only in a situation of incapacitation or terminal illness. In this legal document, you can outline which treatments you wish to receive in different medical situations. You can give instructions on the use of life-sustaining devices such as feeding tubes, respirators and life support. You may also indicate your stance on pain management and organ donation.

By having a living will, you can be assured that you made your own decisions about your health care. Your loved ones will know what you want and won’t need to make difficult choices on your behalf.

A living will may also be called an advance health directive. When completed properly, it is a legally-binding document. Our living will document is written specifically for North Dakota and follows the state’s laws. When completed, signed and witnessed, our living will document is legal throughout the state of North Dakota.

As an added service, we offer safe and secure storage of your living will. You may upload the document to your ezEstatePlanner Vault, where you can access it at any time. You may also designate a loved one who may access your document in a medical emergency.

A living will should not be confused with a living trust or health care power of attorney. To learn more about the different health-related documents you may need, see our article What's the Difference Between a Living Will and a Living Trust?
